The activity usually includes an extrajudicial preventive phase, during which the debtor’s solvency is verified by sending letters of warning signed by a lawyer.
In fact, the verification of the debtor’s financial situation is fundamental in order to assess the feasibility of a judicial action and, if necessary, of an executive intervention on the insolvent’s assets. If the extrajudicial monitoring does not lead to the desired result, we can proceed directly with the debtor to the judicial authority (by means of an injunction).
In the extrajudicial phase, a warning letter is drafted and sent to the debtor, signed by the lawyers, and, at the same time, the important task of assessing the debtor’s solvency is undertaken, which allows the feasibility of a lawsuit and, if necessary, an executive intervention on the debtor’s assets to be assessed.
If the out-of-court warning is unsuccessful, the law firm will proceed directly with the debtor’s appeal to the judicial authority by drafting and filing the appeal by way of injunction. The judge will then issue an order of acceptance, ordering the debtor to pay within 40 days.
If the conditions are met, it will be possible to ask the judge to issue an immediately enforceable injunction ordering the debtor to pay immediately (Article 642 of the Code of Civil Procedure).
Once the injunction has been served and the debtor has been ordered to pay, the law firm will proceed with the enforcement and any subsequent sale of the debtor’s assets to meet the client’s needs.
